Who we are
Suggested text: Our website address is: [website URL]. This website and our coaching services are operated by [Business legal name] (ABN [ABN]) trading as [Trading name].
By using this website, booking a session, paying an invoice or signing a proposal, you agree to these terms and conditions. If you do not agree, do not use this website or our services.
If a signed proposal or coaching agreement conflicts with these terms, the proposal or agreement applies to the extent of the conflict.
Our coaching services
Suggested text: We provide business coaching to help clients set goals, plan and make decisions about their business. The scope, number of sessions, format and duration of your services are set out on this website, in your proposal or in your booking confirmation.
Sessions are held [in person at our premises / online via [platform] / by phone]. Each session runs for [60] minutes unless stated otherwise. We will supply our services with due care and skill and within a reasonable time.
Coaching is not a substitute for professional advice. We do not provide legal, financial, accounting, tax, investment, medical or psychological advice. You should get advice from a suitably qualified professional before you act on matters in those areas.
Results
Suggested text: Business results depend on many factors outside our control, including your decisions, effort, resources and market conditions. We do not guarantee any particular outcome, such as an increase in revenue, profit or client numbers.
Examples, case studies and testimonials on this website describe the experience of individual clients. They are not a promise that you will achieve the same results. You are responsible for the decisions you make and the actions you take in your business.
Fees and payment
Suggested text: Our fees are shown on this website or in your proposal. All prices are in Australian dollars and [include / exclude] GST. We accept payment by [credit card / debit card / bank transfer / other].
Single sessions must be paid in full at the time of booking. Programs must be paid in full before the first session, or by the instalment plan set out in your proposal. Invoices must be paid within [7 / 14] days of the invoice date.
If a payment is overdue, we may pause your services until you pay the amount owing. We will tell you in writing before we do this. If you pay by instalments and stop paying, the remaining instalments are still payable, unless our cancellation terms or the Australian Consumer Law give you a right to a refund or to cancel.
We may change our fees at any time. A change does not affect services you have already paid for or a program you have already started.
Cancellations, rescheduling and refunds
Suggested text: You may reschedule a session at no cost if you give us at least [24 / 48] hours’ notice by [email / our booking system].
If you cancel with less than [24 / 48] hours’ notice, or do not attend, the session is forfeited and is not refunded. If you are more than [15] minutes late, the session will still finish at the scheduled time.
If we need to cancel or reschedule a session, we will give you as much notice as possible and offer a new time. If we cannot offer a suitable new time, we will refund the fee for that session.
Program sessions must be used within [number] months of the program start date. Unused sessions expire after that date, unless we agree otherwise in writing.
[Optional: You may cancel a program within [7] days of purchase for a full refund, if no sessions have taken place.]
Except as set out above, fees are not refundable for change of mind. Nothing in this section limits your rights under the Australian Consumer Law, including your right to a remedy if our services do not meet a consumer guarantee.
Your responsibilities
Suggested text: You agree to give us accurate and complete information that is relevant to our services, attend sessions on time, and complete the actions we agree on between sessions. You also agree to tell us promptly if your circumstances change in a way that affects our services.
We may end a session early, or end our services, if you behave in an abusive, threatening or unlawful way.
Confidentiality and privacy
Suggested text: We keep confidential the information you share with us during coaching. We will not disclose it to anyone else unless you give us permission, the law requires us to disclose it, or we reasonably believe disclosure is necessary to prevent serious harm to you or another person.

Your rights under Australian Consumer Law
Suggested text: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
To the extent the law allows, and where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited to, at our choice, supplying the services again or paying the cost of having the services supplied again.
To the extent the law allows, we are not liable for any indirect or consequential loss, including loss of profit, revenue, business or opportunity. Our total liability to you is limited to the fees you paid for the services that gave rise to the claim.
Ending our services
Suggested text: Either party may end our services by giving written notice to the other. If you end our services, our cancellation and refund terms apply. If we end our services for a reason other than your breach of these terms, we will refund the fees for any sessions not yet delivered.
The sections on confidentiality, content ownership and liability continue to apply after our services end.
